These Terms of Service ("Terms") govern your use of the SetOptics website at setoptics.com and the SetOptics video analysis platform (the "Service"), operated by SetOptics ("we," "us," or "our").
By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is currently in beta. Features may change, break, or be removed without notice. We provide the Service on an "as is" and "as available" basis during the beta period, without warranty of any kind.
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate information when creating your account. You may delete your account at any time.
You retain ownership of all video content you upload to the Service ("Your Content"). By uploading content, you grant us a non-exclusive, worldwide, royalty-free license to store, process, and analyze Your Content solely to provide the Service to you.
You represent that you have the right to upload Your Content and that it does not infringe any third party's intellectual property or other rights.

The Service uses a credit-based system. During the beta period, credits are provided free of charge at sign-up. Each credit represents one minute of source footage processed.
When paid plans are introduced after the beta period, separate payment terms will apply.
We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content on the Service infringes your copyright, please see our DMCA Policy for instructions on submitting a takedown notice.
We maintain a repeat infringer policy and may terminate accounts of users who repeatedly infringe copyrights.
To the maximum extent permitted by law, SetOptics shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.
You agree to indemnify and hold harmless SetOptics from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases and we may delete your data in accordance with our Privacy Policy.
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in California.
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
